4. Regulation 17 and 18 - Examination and Examiner's Report (2020)

Following the formal consultation between 17 September and 29 October 2019 on the draft the Haworth, Cross Roads and Stanbury Neighbourhood Development Plan (under Regulation 16 of the Neighbourhood Planning (General) Regulations 2012), the plan has now been submitted for independent examination.

Rosemary Kidd DipTP MRTPI of the Rosemary Kidd Planning Consultancy was appointed to carry out the independent examination. Copies of the draft Neighbourhood Plan, supporting document and representations received during the consultation on the Regulation 16 version of the plan were provided to the examiner for their consideration.

The examination considered whether the plan meets the basic conditions and other requirements set out in law, in particular whether it:

  • has regard to national policy
  • contributes to the achievement of sustainable development
  • is in general conformity with the adopted strategic policies for the local area
  • is compatible with EU obligations
  • meets human rights requirements.

The examiner prepared a Procedural Note, regarding how the examination will be managed and setting out a number of points that they wished Bradford Council and/or the Parish Council to clarify.

Following receipt of the Parish Council and Bradford Council responses to her initial questions, the Examiner issued further questions for both bodies.

Examiner's Report

Following the examination of Haworth, Cross Roads and Stanbury Neighbourhood Development Plan, it was recommended that, subject to a number of modifications, the plan should move forward to referendum.

The examiner's report and recommendations were considered at the council's Executive meeting on 6 October 2020 and it was decided that the plan should to be put to a referendum.
